4) When Should a First Appeal Be Filed in RTI?

If an applicant does not receive a response to their RTI application or receives incomplete or incorrect information, they have the right to file a First Appeal.

A First Appeal can be filed in the following situations:

  • No reply received within 30 days
  • Incomplete information provided
  • Incorrect or misleading information provided
  • The request for information was rejected without proper reason

The First Appeal must be filed before the First Appellate Authority (FAA) of the same department where the RTI application was submitted.

Generally, the First Appeal should be filed within 30 days from the date of receiving the RTI reply or from the date when the reply was expected.
