5) What is a Second Appeal in RTI?

If the applicant is not satisfied with the decision of the First Appellate Authority, they can file a Second Appeal under the Right to Information Act, 2005.

The Second Appeal is filed before the appropriate Information Commission:

  • Central Information Commission for central government departments
  • State Information Commission for state government departments

A Second Appeal must generally be filed within 90 days from the date of the decision of the First Appeal.

The Information Commission examines the matter and may pass an order directing the public authority to provide the requested information if it finds the appeal valid.
